Perpetrated in an era marked by the globalization of State terror, the international and official action of sabotage of the Freedom Flotilla is a founding event in the history of the world popular movement and of solidarity between the peoples. Orchestrated by the ruling world establishment, this action has displayed ominous levels of cooperation and coordination between governments, intelligence services and special military forces, all directed against a popular movement. What we are here dealing with is nothing less than a cartel of official terror set up by those, among States and regimes, who monopolize the means of repression. It is a cartel meant to disable or destroy the peaceful movements that rise and organize in numerous parts of the world in active solidarity with the Palestinian people, in the struggle to break the Gaza blockade.

Needless to say, the many States which took part in this inglorious action share with Israel this crime committed against the Palestinian People and the supporters of its rights.

Amidst these developments withal, a fact of high significance emerges : at the very time the Flotilla was enduring the military, judiciary and overtly terrorist sabotage action seeking to prevent it from sailing to Gaza in early July 2011, this besieged territory gained more freedom. This is the feeling that prevails among us, we, the prisonners of freedom in Israeli jails, the feeling that, thanks to the Flotilla and all the agitation it provoked, freedom is more than ever before within reach.

In these dramatic events, what truly stands out is the greatness and influence of the world peoples’ solidarity movements, especially the « Free Gaza » movement. It is only owing to their growing force that the governments and regimes which participated with Israel in the terrorist action were compelled to act unmasked and, so to speak, in broad daylight. The unprecedented display of brute repressive and military force against peaceful supporters of the Palestinian people is in itself a sign that the Gaza blockade has been shaken more strongly than ever before since its instauration.

We also note that the voices who expressed their hostility towards the Freedom Flotilla -including the Secretary General of the United Nations !- are the same who, on May 15, 2011 and June the fifth following, stood against the mass movements of refugees commemorating the Naksa and the Nakba. These refugees who sought to demonstrate their right to return to their homeland - a right that enjoys international recognition including in U.N resolutions- were accused of provocation against Israël, this regime whose very essence is military occupation, forced mass exodus and ethnic cleansing ! But now, what has become more clear than ever is the ever deepening crisis of Israel itself, a crisis whose root is none other than the question of its legitimacy as a colonial and racist regime. A question that is gaining ground and relevance in the world popular movements.

An important evolution may be observed in the present-day worldwide wave of popular solidarity with the Palestinian people. It is in that many more militants are willing to pay a higher price for their struggle to promote Palestinian rights, including facing the dangers which the confrontation with Israel and its accomplices entail. Despite these dangers, the peoples’ solidarity movements continue to extend, gaining strength and influence, confining Israel in a defensive position and stripping it off its legitimacy.

What we are witnessing here is solidarity in the truest sense of the word. It is what the peoples of the world are capable of doing when, in the face of the unequal struggle between the oppressor and the oppressed, they naturally find their place on the side of the oppressed, with the victims of agression, repression , mass detention, occupation and racism.

We know now, after the Israeli and international aggression against the Freedom Flotilla, that the partners in crime with Israel no longer scruple to use and display in full view all the means at their disposal- governments, mass-media, intelligence services, elite military forces and judiciary organs- to pursue the aim of further deepening the unequal balance of power in favor of Israel and to the detriment of the Palestinian people and its cause. This is nothing other than a display of contempt for the peoples who, in this vision, do not count when the interests of the world power structure are at stake.

The European Union set itself the task of defaming the Freedom Flotilla and shedding doubt on its legitimacy but it must be noted that the American Administration, not surprisingly, had preceded it in this base deed. But the worst had yet to come and It came from Great Britain which took the political decision of arresting Cheikh Raed Salah, one of the most prominent leaders of the Palestinian people and a leader in the world movement to end the Gaza Blocus. The campaign of slander unleashed against him and against what he represents, which is nothing more than a gross replication of Israeli propaganda, is most telling for onewho wants to know the collusion or even the obedience of certain circles with Israel and the Zionist lobby.

By arresting Sheikh Raed Salah, Great Britain allowed Israel to pervert and steal away one of the means that the world civil society uses to promote just causes, namely and in the case of Great Britain , the recourse to the courts to pursue and arrest Israeli war criminals among politicians and generals. It is important to remember that when the Palestinian Centre for Human Rights, along with British supporters, obtained from the court a warrant for the arrest of Doron Almog, this general responsible for the murder of the martyr Salah Shehad and his family of thirteen members in Gaza, the British authorities leaked the warrant to the Israeli embassy which then informed Doron Almog, allowing him to flee and evade British justice. Justice thus, which was for the victims of occupation, racism and colonialism a place where their rights could be heard was transformed, by the occupier and its war criminals, into a means for inflicting further oppression to their victims, a means which appends to the Israeli racist repressive legal machinery, the laws of the countries whose governments are involved in crime with Israel.

Greece which is linked to Israel by an ever expanding system of military and security cooperation, including joint military exercises, launched a military operation to disable the Flotilla. Its special naval commando units went as far as blowing up the ships’ engines. But the use of brute force did not prevent it from putting into action its judiciary apparatus to deter the Flotilla from sailing for Gaza and when this partially happened, It again used its military force at sea to besiege the ships and force them under gunpoint to return to the port. All these actions were, of course, highly praised by Israel. Cyprus, for its part, distinguished itself by announcing its decision to ban the ships from its territorial waters. Turkey’s position, all the while, was marked by a singular lack of resolution and this, not just because of the explosions which struck one of the ships in its own ports but also because of the decisions it took not to participate. Most notably, it prevented the Mavi Marmara from joining the Flotilla despite this ship’s status as a symbol of solidarity with Gaza, a status which it gained after the bloody Israeli attack against it.

Once again, we are compelled to suffer the sight of a pitifully weak official Palestinian position, upheld by both the Palestinian Authority and the PLO which, in the face of the criminal Israeli and international enterprise against the Flotilla, found no better posture than that of presenting themselves as an almost unconcerned « third party » in a conflict in which their people is the main victim ! We must also note that, all along these events, the security cooperation of the Palestinian Authority with Israel was not discontinued or questioned for even one moment.

We expected more from revolutionary Egypt. This State whose potential is that of a regional power had the possibility to offer the Flotilla safe harbour in its ports and protection during its trip to Gaza because its territorial waters are closer to Gaza than to Israel. But Egypt refrained from providing that help for the reason that, with the present regime, it still accepts to remain entrapped in the Camp David agreements, as is Palestine entrapped. It is true that Egypt after the revolution opened the Rafah crossing and this an act of great importance, but it must be remarked that when you are capable of opening the crossing, you are no less capable of protecting the Flotilla. For all the progress and relief it has brought, the opening of the Rafah crossing does not put an end to the blockade nor is it sufficient to break it. We must also note that Egypt, Jordan and the Palestinian Authority are still continuing their security coordination with Israel and this is dangerous because, ultimately, this coordination is nothing else than a repressive siege on the Palestinian and Arab peoples, a siege that mocks Arab and, especially , Egyptian sovereignty.

There is here, unfortunately, an important lesson : Arab revolutions are still incapable of clearly defining regional responsibilities. This explains why their influence was too weak to prevent the European Union, Greece, Great Britain or Cyprus from displaying with such impudence and brutality their hostility towards the Freedom Flotilla and the movement seeking to break the blockade imposed on our people.

Israel, predictably, had laid the ground for a bloody attack on the Flotilla by launching a campaign inciting to the murder of the Flotilla’s people, by spreading outright lies about them and their intentions and about the nature of the goods they meant to transport to Gaza.

Despite the crudeness of theses lies, a crudeness which their most known journalists have knowledge of, the commandeered media of Israel continued to publicise them as if they believed in the ability of their sole imagination to create irrefutable proof ! The peoples and the supporters of the Palestinian people’s rights are, of course, unaffected by the lies of the Israeli media but we must recognize that Israel aptly received the signal it got after its bloody attack of the Flotilla in june 2010 : a licence for renewed ferocity in crime. But this time, the crime was largely committed by proxy, at the hands of the governments of Great Britain, Greece, Cyprus, the European Union and the USA in a clear attempt to white wash it. Should this attempt succeed by its perpetrators’ standards, it will not fail to be re-enacted.

To sum up, a few points need to be highlighted. They are :

1)The unveiling of the nature of the international official establishment and the shift from one-State terrorism to collective, multi-State, organized and complementary terrorism. Terrorism has now been adopted by the world ruling system as an essential means to repress peaceful popular solidarity movements which militate within the framework of international law and Human Rights conventions. The repressive means include the use of the military institutions.

2) The presence on an ever-broadening scale of the world solidarity movements and the importance, for the Palestinian movement, of intensifying interaction with them. These movements constitute a worldwide line of defence for our people and its struggle. Also, as these movements struggle for the advancement of Human Rights and the Rights of Peoples, an international campaign seeking to provide them the protection they need, based upon international law and conventions, must be promoted.

3) The need to pay greater attention to the task of better integrating the Palestinian cause in the Arab revolutions, especially the Egyptian revolution.

4) The necessity to end the security coordination between Egypt, Jordan and the Palestinian Authority with Israel. Also, pressure must be exerted on the Egyptian regime so that it liberates itself from the Camp David agreements, these agreements which rooted out Egypt from its Arab vocation and its place in the conflict with Israel.

5) The preparation of the next Flotilla which must benefit from the lessons of the latest. Among these lessons, the necessity to break the security belt which Israel set for itself with the help of the hostile governments mentioned.

There are lessons to be learned in these events but the great truth that emerges is that the Freedom Flotilla, without even sailing, has reached Gaza and Gaza, as all of Palestine, has reached the hearts of the peoples of the world. This is the fruit of our struggle and the struggle of our supporters, the partners of our people in Liberty.

Το ακόλουθο άρθρο γράφτηκε μετά την ομιλία του ισραηλινού πρωθυπουργού στο ισραηλινό Προεδρικό Συνέδριο στις 23 Ιουνίου 2011. Κατά τη διάρκεια της ομιλίας του, ο Νετανιάχου ανακοίνωσε ότι το Ισραήλ θα επέβαλε μια σειρά μέτρων για να καταστούν αυστηρότεροι οι όροι κράτησης των Παλαιστινίων πολιτικών κρατουμένων, δηλώνοντας ότι «το πάρτι τελείωσε».
Την Παρασκευή, 24 Ιουνίου στις 12:46 μμ., η διοίκηση των φυλακών μας έφερε , στους κρατούμενους, ένα καρπούζι. Ήταν το πρώτο μας καρπούζι το 2011. Σύμφωνα με τον κανονισμό των φυλακών αντιστοιχούν σε κάθε κρατούμενο 180 γραμμάρια φρούτων ημερησίως. Είναι ένα από τα βασικά μας δικαιώματα. Αλλά πριν από λίγες μέρες, επειδή προφανώς δεν υπήρχε διαθεσιμότητα φρούτων, μας έδωσαν από   ένα κρεμμύδι, ως εναλλακτική λύση ή αντάλλαγμα.

Όλοι συμμετέχουμε στο ‘’καρπούζι πάρτι’’. Κάθε τμήμα που έχει 120 κρατούμενους ,παίρνει τρία καρπούζια. Οι φυλακισμένοι κρατούνται σε χωριστά και απομονωμένα τμήματα και επιλέγονται ανάλογα με την προέλευσή τους: Αυτοί που έρχονται από την Ιερουσαλήμ, την Παλαιστίνη του 1948 και το Συριακό Γκολάν  αποτελούν το πρώτο τμήμα. Εκείνοι που προέρχονται από τη Δυτική Όχθη αποτελούν  το δεύτερο, και οι συμπατριώτες μας από τη Λωρίδα της Γάζας είναι στο τρίτο. Εκτός αυτού, στις φυλακές στα νότια της χώρας, οι κρατούμενοι χωρίζονται ανάλογα με την πολιτική παράταξη στην οποία ανήκουν, και τα τέσσερα τελευταία χρόνια τούς έχουν απαγορεύσει κάθε επισκεπτήριο.
Για κάθε 40 κρατούμενους αναλογεί ένα καρπούζι μεσαίου μεγέθους . Όπως πάντα, υπάρχει ένα ειδικό προσωπικό ,που αποτελείται από φυλακισμένους ,το οποίο είναι επιφορτισμένο με τη διανομή τροφίμων. Αυτή τη φορά, το έργο τους ήταν ιδιαίτερα δύσκολο: Κάθε καρπούζι έπρεπε να κοπεί σε 40 ίσια μέρη! Στο τέλος, κάθε κρατούμενος έλαβε ένα κομμάτι καρπούζι σε σχήμα ισοσκελούς τριγώνου , του οποίου οι ίσες πλευρές ήταν κόκκινες και η βάση ήταν πράσινη. Η τελευταία -δηλαδή, η φλούδα-υπολογίστηκε στα 180 γραμμάρια των φρούτων μας την ημέρα.
Η εμπειρία με το καρπούζι μου θυμίζει το λαϊκό μύθο  του Αλή Μπαμπά και οι σαράντα κλέφτες.Η αντιστοιχία δεν είναι απλώς αριθμητική: στο μύθο οι 40 κλέφτες κλείστηκαν σε μια σπηλιά, η είσοδος της οποίας σφραγίστηκε με μαγικό τρόπο, για να αποφύγουν  τη δικαιοσύνη . Αντίθετα, στη ζωή μας υπάρχει μόνο ένας κλέφτης και ζει ελεύθερος. Ο δικός μας κλέφτης συνεχίζει να ληστεύει την ελευθερία, ένα έθνος και ένα λαό κλειδώνοντάς μας πίσω από τα κάγκελα. Αλλά όταν κοιτάμε μακρύτερα βλέπουμε ότι οι ορίζοντες του κλέφτη συνεχώς στενεύουν.
Τα εγκλήματα του κλέφτη μας μπορεί να αποκαλυφθούν μέσω της ρήξης. Δεν είμαστε απογοητευμένοι, γιατί  τα   επονομαζόμενα ‘’τμήματα’’, ‘’κομμάτια ’’ ή ‘’κόμματά ‘’ μας στις φυλακές έχουν  γεύση, γιατί τα ετοιμάζουμε εμείς οι ίδιοι. Επιπλέον δεν είμαστε ορφανοί , γιατί   έξω από τα τείχη της φυλακής είναι ο λαός μας, που αγωνίζεται για την ελευθερία. Μέχρι πότε; Μόνο εμείς, ως κρατούμενοι και ως  λαός , μπορούμε να απαντήσουμε σε αυτό το ερώτημα.

The story of the watermelon and the forty prisone

For every forty prisoners, there was one middle-sized watermelon distributed in Gilboa prison this summer.
This piece was written from Gilboa prison following Israeli Prime Minister’s speech at the Israeli Presidential Conference on 23 June, 2011. On Friday, 24 June at 12:46 pm, the prison administration brought us, the prisoners, a watermelon. It was our first watermelon of 2011. According to the prison regulations, each prisoner gets 180 grams of fruit each day. It’s one of our basic rights. However, a few days ago, when it seemed that fruits were unavailable, each of us was provided with an onion as an alternative, or compensation.
On that day, all of us had a share in the watermelon “party.” Each prison section, containing 120 prisoners, received the total number of three watermelons. The prisoners are divided into separate and isolated sections according to where they come from: while those who come from Jerusalem, ‘48 Palestine and the Golan Heights compile the first section; those of theWest Bank are in the second; and our compatriots from the Gaza Strip are in the third. And not only that, in the prisons in the south of the country the prisoners are divided also according to the the political faction they belong to, and for the last four years they have been prevented from receiving any guests.
For every forty prisoners, there was one middle-sized watermelon. As always, we have a special staff composed of prisoners that is in charge of distributing the food. This time, its task was especially difficult: each watermelon had to be cut into forty equal pieces! At the end, each prisoner received a watermelon piece in the shape of an isosceles triangle, whose equal sides are red and the base green. The latter — that is, the rind — was calculated into our 180 grams of fruit a day.
Thief of freedom
Our watermelon experience brought to my mind the popular story of “Ali Baba and the Forty Thieves.” The analogy is not a purely a numerical one: in the story, forty thieves were locked in a cave — the mouth of which was sealed by magic — while hiding from justice; in our life, however, there is only one thief, who lives in the open. Our thief continues to rob freedom, a nation and a people by locking us behind closed bars. But, when we look at the horizon, we see the thief’s world slowly closing up on him.
The crimes of our thief can be exposed by confrontation. We are not disillusioned, but our so-called “parties” inside the prison bars do have a taste, because we prepare them ourselves. Also, we are not orphans, for outside the prison walls our people are struggling for liberation. Until when? Only we, as prisoners and as a people, can answer this question.

The following piece was written following the Israeli Prime Minister's speech at the Israeli Presidential Conference on 23 June 23, 2011. On Friday 24 June at 12:46 pm., the prison administration brought a watermelon for the prisoners. It was our first watermelon in 2011. According to prison regulations, each prisoner gets 180 grams of fruit each day. It's one of our basic rights. However, several days ago, as it seems that fruit was unavailable, each of us was provided with an onion as an alternative, or in compensation.

All of us shared in the watermelon “party.” Each prison section, containing 120 prisoners, received the total number of three watermelons. The prisoners are divided into separate and isolated sections according to where they come from: Those who come from Jerusalem, 1948 Palestine and the Syrian Golan compile the first section; those from the West Bank are in the second; and our compatriots from the Gaza Strip are in the third. And not only that, for in the prisons in the south of the country, prisoners are also divided according to the political faction to which they belong, and for the last four years they have been prevented from receiving any guests.

For every 40 prisoners there corresponded one medium-sized watermelon. As always, we have a special staff of prisoners in charge of distributing food. At the end, each prisoner received a watermelon piece in the shape of an isosceles triangle, whose equal sides are red and the base is green. The analogy is not purely numerical:  In the story, 40 thieves were locked in a cave, the mouth of which was sealed by magic, while hiding from justice. In our life, however, there is only one thief, who lives out in the open. Our thief continues to rob freedom, a nation and a people by locking us behind closed bars. Yet when we look at the horizon, we see the thief's world slowly closing in on him.

The crimes of our thief can be exposed by confrontation. We are not disillusioned, but our so-called “parties” inside the prison bars do have a taste, because we prepare them ourselves. Additionally, orphans we are not, for outside the prison walls it is our people who is struggling for liberation. Until when? Only we, as prisoners and as a people, can answer this question.

כבר תשע שנים שאנשי הסניגוריה הציבורית מפרסמים ממצאים קשים על תנאי הכליאה בישראל והפגיעה המתמשכת בזכויות האדם של האסירים – בלי כל שינוי משמעותי. ניתן היה לצפות שהמחאה החברתית תירתם גם היא למאבק בנושא
רמת הצפיפות במתקני הכליאה בישראל רחוקה מן הסטנדרט המקובל במדינות מתקדמות, ומובילה לירידה עקבית בגודלו של מרחב המחייה לאסיר; ישנם ליקויים חמורים הנוגעים לנגישותם של אסירים לערכאות משפטיות, כמו הליך עתירות האסירים המתקיים בפני בית המשפט המחוזי או שחרור מוקדם ממאסר המתקיים בפני ועדות השחרורים; מסקנות קשות אלה ואחרות עולות מן הדו"ח האחרון, התשיעי במספר, שפרסמו משרד המשפטים והסנגוריה הציבורית באוגוסט האחרון, בשם: "תנאי המעצר והמאסר ושמירת זכויות העצורים והאסירים במתקני הכליאה של שירותי בתי הסוהר ומשטרת ישראל ושל בתי המשפט, בשנים 2009-2010, ותחילת שנת 2011".
הדו"ח מרכז ומסכם את הממצאים העיקריים העולים מדו"חות הביקורת שערכו אנשי הסנגוריה הציבורית בנידון, ושנרשמו בעקבות ביקורים שלהם ב-26 מתקני כליאה שבאחריות בתי הסוהר, 10 מתקני מעצר שבאחריות משטרת ישראל, ו-13 מתקני מעצר בבתי המשפט המיועדים להחזקתם של עצורים ואסירים המובאים לבית המשפט לצורך קיום דיונים בעניינם.1 במסגרת הביקורים הללו, נבדקה מידת התאמתם של מתקני המעצר לתנאים שנקבעו כתנאים מינימליים.2 "נציין, כי במהלך עבודתנו המערכתית השוטפת נתקלנו בליקויים קשים בתנאי כליאה גם שלא אגב עריכת ביקור רשמי", כותבים אנשי הסניגוריה, "בחרנו לכלול את המידע הידוע לנו מעבודה שוטפת זו בדו"ח. זאת, נוכח חומרתם של הדברים והרלוונטיות שלהם לליקויים שעלו ממילא במהלך הביקורים הרשמיים".
הכותבים מתריעים על ליקויים חומריים הקיימים בשלושת סוגי מסגרות הכליאה אליהם מתייחס הדו"ח, הנה סיכום הדברים:
1. מתקנים שבאחריות השב"ס
התמונה העולה מבדיקת חלק מבתי הסוהר עגומה: ענישה משמעתית קיצונית; שימוש בכבילה לא-מידתית; צפיפות רבה; תנאים תברואתיים ירודים, לפעמים עד כדי סכנה ממשית לבריאותם של אסירים; תנאי אוורור בלתי-נאותים; אי-הפרדה בין המקלחת לשירותים, כך שאסירים נאלצים להתקלח מעל המקום בו עשו אסירים אחרים את צרכיהם; מחסור בציוד בסיסי לאסירים; ליקויים במתן טיפול רפואי; ליקויים בתהליך הגשת עתירות אסירים ובהליכי ועדות שחרורים ועוד.
על התנאים הפיסיים נכתב: "עזובה פיסית ותנאי מגורים קשים ביותר, של צפיפות גדולה ומחנק בתאים ושל מבנים שאינם עונים לקני המידה הבסיסיים המתחייבים מן הדין ומקביעות בתי המשפט, לרבות בית המשפט העליון (…) כדי לתת לאסירים תנאי מחייה סבירים, יש לדאוג כי לכל אסיר יהיה גם מרחב מחייה מינימאלי המאפשר שמירה על כבודו כאדם. למרבה הצער, בחלק ניכר ממתקני שב"ס בהם ביקרנו הצפיפות הקשה בתאים אינה עולה בקנה מידה אחד עם שמירה על כבוד האדם של האסיר או העציר".
ליקוי מדאיג נוסף קשור לפן הטיפולי-סוציאלי, והוא מתבטא בין היתר ב"מחסור בעובדים סוציאליים ביחס לכמות האסירים הרבה… בשלילה גורפת של טיפול סוציאלי לאוכלוסיית האסירים הביטחוניים; ובליקויים הנוגעים למסגרות החינוך, התעסוקה והפנאי. יודגש, כי הליקויים בתחומים אלה אינם מתיישבים כלל עם מטרות הכליאה, שאינן רק הרחקה מן החברה כי אם גם הזדמנות לשיקום, למניעת חזרה עתידית על עבירות ולשילוב נורמטיבי בקהילה".
בית הכלא הופך במצב הזה למקום שמשרת את אותה המטרה ממנה מתריעים אנשי הסנגוריה: הרחקה מהחברה והרתעה, בעיקר כאשר הוא לא מאפשר שום מגע עם העולם שעומד מחוץ לכותלי בית הכלא, כמו במקרה של האסירים הפוליטיים.
2. מתקני הכליאה שבאחריות משטרת ישראל
הממצאים דומים, ואף קשים עוד יותר. אמנם, מציין הדו"ח, בחלק מהמתקנים הללו הדבר נובע ממגבלות אובייקטיביות הנוגעות לגודל המתקן ולתקופה שבה נבנה, אולם עם מרבית הליקויים לא ניתן להשלים. לטענת הסנגוריה הציבורית, יש להשקיע משאבים על מנת להביא לתיקון הליקויים בהקדם האפשרי. למשל: "תנאי מעצר קטנים וצפופים; ליקויים חמורים בשירותים ובמקלחות, כך שעצורים נאלצים להתקלח מעל חור הניקוז של השירותים; הפרת זכותם של עצורים להיפגש עם עורך דין בתנאים הולמים וללא דיחוי; הפרת הזכות להליכה יומית באוויר הפתוח, ועוד".
הדו"ח מציין עוד, "בעיות במימוש הזכות לקשר עם בני משפחה, הזכות למפגש עם עורך דין וזכות הגישה החופשית לערכאות, שיפוטיות". חשוב לציין כאן, שבמקרים מסוימים אף התריעו עורכי דין על חשש מהאזנה לא חוקית לשיחות שלהם עם העצורים/אסירים אשר מתנהלות דרך שפופרת ומאחורי זכוכית מפרידה.
3. מתקני הכליאה של בתי המשפט ברחבי הארץ
המצב באלה אינו טוב יותר מאשר בשני סוגי המתקנים הקודמים. בין היתר נמצא, כי "בחלק ממתקני המעצר שוררת צפיפות בלתי נסבלת; רוב-רובם של המתקנים מאופיינים בתנאי תברואה ואוורור ירודים ביותר; קיימים ליקויים רבים במצבם של השירותים; במקומות רבים לא קיימים תנאים לקיומם של מפגשי עורך דין-לקוח באווירה מכובדת ובטוחה, מצב המוביל לפגיעה בזכות ההיוועצות..".
עוד עולה מהדו"ח כי "הניהול השוטף של ליווי העצורים לבתי המשפט על ידי שב"ס, עודו מתאפיין בליקויים רבים המביאים לפגיעה חמורה בזכויותיהם של כלואים, כגון טלטול בדרכים במשך שעות רבות, והארכת משך שהייתם במתקני המעצר שבביהמ"ש מעבר לנדרש להליך המשפטי בעניינם, כל זאת בתנאי מעצר קטנים וצפופים שאינם מיועדים אלא להחזקת עצורים מעטים ולשעות בודדות. לכן יש להוסיף, כן הן סדרי הליווי אל מתקני המעצר והן סדרי הליווי אל אולמות הדיון שבתוך המתקנים עצמם, גורמים במקרים לא מעטים להובלת עצורים כשהם אזוקים לעיני הציבור הרחב, תוך פגיעה חמורה בכבודם."
זאת על אף העובדה ש"סעיף 9 א' לחוק סדר הדין הפלילי (סמכויות אכיפה- מעצרים) התשנ"ו-1996, שעניינו כבילת עצור במקום ציבורי, קובע כי "עצורים לא יהיו כבולים במקום ציבורי, אלא בהתקיימם של חריגים המנויים בסעיף".
הליקויים עליהם מדבר הדו"ח מתייחסים גם להובלת העצורים אל מתקן המעצר ולאולמות הדיון, כמו גם בפיזורם למתקני הכליאה השונים לאחר תום הדיון. על ההפרות בתנאי ההובלה, נכתב שם "השילוב של יציאה כה מוקדמת ממתקני הכליאה השונים, נסיעה ארוכה ואי חלוקת מזון במהלכה, מוביל לכך שעצורים מגיעים לדיונים בבית המשפט, העשויים להיות גורליים עבורם, כשהם מותשים, רעבים ומתוסכלים". כן נכתב על ליקויים באספקת מזון ושתייה לעצורים ועל לכלוך, מחנק וצחנה בתאים בהם מוחזקים בבתי המשפט, על תאים מעצר קטנים וצפופים, ועל ליקויים הנוגעים לתאי השירותים.
יש לציין ש"ממצאי הביקורים… הועלו על הכתב בדו"חות ביקורת פרטניים, שהועברו ליועץ המשפט לממשלה ולמשנהו, לשר לביטחון פנים, לשר המשפטים ולגורמים רלוונטיים נוספים, כגון נשיאים של בתי המשפט בהם נערכו הביקורות, מנהל בתי המשפט, מפכ"ל המשטרה, נציב שירותי בתי הסוהר, היועץ המשפטי לשירות בתי הסוהר, היועץ המשפטי למשרד לביטחון פנים, מבקר המשרד לביטחון פנים ועוד".
אנשי הסנגוריה הציבורית, שקיבלו את המינוי כמבקרים רשמיים בבתי הסוהר ובתי המעצר מאז שנת 1999, רואים ב"שמירה קפדנית על זכויותיהם ועל כבודם של מי שהחברה שוללת, על פי דין, את חירותם, את אחד המבחנים המרכזיים לשמירה על זכויות האדם במדינת ישראל". מתוך כך הם מוסיפים: "אכן המאסר מחייב, מעצם מהותו, שלילית חופש, אך אין בו כדי להצדיק, מעצם מהותו, פגיעה בכבוד האדם. ניתן לקיים מאסר שישמור על כבוד האדם של האסיר. חומות הכלא אינן צריכות להפריד בין האסיר לבין צלם האנוש… בית סוהר אסור לו שייהפך למכלאה, וחדר האסיר אסור לו שייהפך לכלוב… לא נהיה אנושיים אם לא נבטיח רמה אנושית לאסירים שבחברתנו. אין להשיג את מטרותיה של הענישה הפלילית על-ידי פגיעה בכבוד האסיר ובצלמו כאדם".
אך התמונה שמצטיירת מהדו"ח מראה שבתי הסוהר אכן הפכו במובן מסוים, לאותה מכלאה שממנה מזהירים אנשי הסנגוריה, בעיקר לגבי אוכלוסיות וקבוצות מסוימות, כגון האסירים הפוליטיים. התמונה שמצטיירת מהדו"ח מעמידה בספק רב את האפשרות שישראל צלחה באותו מבחן של שמירה על זכויות אדם, ועל זכויות האסיר כבן אדם. לפי הדו"ח נראה ש"למרות הניסיונות להביא לשיפור המצב ובראשם העברת האחריות על מתקני המעצר המרחביים ועל מערך ליווי העצורים מן המשטרה אל שב"ס, המצב במתקני הכליאה בהם ביקרו אנשי הסנגוריה הציבורית בשנים 2009-2010 רחוק עדיין מלהשביע רצון".
הדו"ח אף מדבר על "המצב הקשה והמצער הקיים בחלק מן המתקנים" ומציין ש"אין מדובר בבעיות או בכשלים נקודתיים ומקומיים. מדובר בבעיה כלל-ארצית, המביאה לפגיעה יומיומית בזכויותיהם הבסיסיות של עצורים ואסירים, ולפגיעה בכבודם כבני אדם". כלומר, הפרת זכויות האדם במתקני הכליאה בישראל, היא פרי מדיניות כלל ארצית ושיטה שמבטיחה את קיומה בכל בתי הסוהר ואת המשך קיומה – למרות ההתרעה לשנה התשיעית ברציפות על חומרתה. ישראל, בכל הקשור לזכויות אדם ולהבטחת מצב אנושי במתקני הכליאה וביחס לאסירים ולעצורים, נכשלה במודע ובכוונה תחילה. עיון במסקנות ובהמלצות של הדו"ח מביא להטלת ספק רב באפשרות של חוסר ידיעתם של האחראים בדבר המצב החמור הקיים במתקנים אלו, או בכלל את היותם מופתעים מהעובדות שמציג הדו"ח.
כותבי הדו"ח מסכמים "בתקווה שהרשויות הממונות ישכילו לעשות שימוש במידע המובא בדו"ח, על מנת להביא לשיפור כולל ומהיר של הליקויים החמורים המתוארים בו". אולם השארת המצב כמות שהוא בין אנשי הסנגוריה שכותבים ומגישים דו"חות לבין אותם גורמים ישראלים רלוונטיים שמקבלים אותם, משאירה את המצב כמו שישראל רוצה שיהיה: עניין פנימי הנתון לשיקול דעתה; אז מי ידאג לאותם אסירים? כיצד נביא לשינוי המצב והשיטה? ולהפסקת הסבל של האסירים?
ההפרות בזכויות האדם בבתי הכלא אמורות להדאיג לא רק את אנשי הסנגוריה, לא רק את האסירים ומשפחותיהם הסובלים ישירות, אלא את כל מי שמרים את דגל זכויות האדם. דאגה מיוחדת נתונה למצבם של האסירים הפוליטיים שבשב"ס קוראים להם "הביטחוניים". אסיר ביטחוני במתקני כליאה בישראל חיי בתת-תנאים אנושיים ופיסיים, המונעים ממנו לא רק תנאי מחייה בסיסיים הולמים, אלא אף מבודדים אותו טוטאלית מכל מגע עם העולם החיצון חוץ מקרובי משפחה דרגה ראשונה. גם אלה ניתנים בתנאים מאד לא-אנושיים, כמו מניעת מגע אפילו עם קטינים וקשישים, ומתקיימים כאשר קיר זכוכית מפריד ביניהם. אסירים אלו אינם זוכים כמו אסירים פליליים לביקורי קרובי משפחה מדרגה שנייה. הם מנועים מלדבר בטלפון, מנועים מלצאת מכתלי בית הסוהר אפילו למקרים חריגים כמו ביקור הורים קשישים וחולים. ביקור פתוח עם הורה יתכן רק במקרה אם ההורה במצב סופני, והדבר נתון לשיקול דעתו של מנהל בית המעצר.
עולמו החברתי של האסיר הביטחוני מצומצם לאסירים בתא ולכל היותר באגף, ולבני משפחה דרגה ראשונה. הוא מתרכז לכדי פעילות מינימאלית ביותר, מכיוון שנמנעת ממנו כל גישה לפעילות חברתית או חינוכית. מרחב המחייה מתמצה במרחק בין התא, לשירותים, לחצר הפנימית, לחדר המבקרים אליו הוא זוכה להגיע ללא יותר מ-45 דקות, אחת לשבועיים. האסירים הביטחוניים גם לא זוכים לכל שירות סוציאלי, כגון שיחות נפש, קבוצות תמיכה וכו'.
יש לציין שבמקביל לסיום כתיבת הדו"ח, ועוד לפני פרסומו, נקטו בבתי הסוהר ולפי החלטה ממשלתית במספר עונשים קולקטיביים כנגד האסירים הפוליטיים, בהם הפסקת העברת ספרים דרך בני משפחה, הפסקת הלימודים באופן גורף, חיפושים משפילים על גופם של משפחות האסירים בחלק מבתי סוהר, חיפושים פתאומיים בתאי המעצר במהלך שעות השינה הידועים בשם "גירוד" – כי בהם אפילו קירות התא לא נשארים שלמים.
כאן אני מעלה תהייה, בעיקר אל מול המחאה החברתית בישראל והקריאה לשינוי השיטה והמנגנון השליט, בה לוקחים יחידים וארגונים ואיגודים מקצועיים: אני שואלת, גם בתור עובדת סוציאלית ופעילה בתחום זכויות אדם, למה איגוד העובדים הסוציאליים אינו מותח ביקורת על המצב הקיים בתוך בתי הסוהר? למה הוא מקבל על עצמו עובדה לפיה השירות הסוציאלי מקופח בבתי הסוהר, בעיקר לאסירים הביטחוניים? למה שותק איגוד הרופאים אל מול העובדה שהטיפולים הרפואיים הניתנים לאסירים לוקים בחסר רב. ומה עושה לשכת עורכי הדין עם העובדה שתנאי המפגש של עו"ד עם אסיר מופרת בתוך מתקני הכליאה ומקבלת לגיטימציה חוקית?
מדוע ארגוני זכויות הילד שותקים על כך שילדים מעל גיל שמונה, אם הם בניהם של אסירים ביטחוניים, אינם זכאים בהתאם לתקנות השב"ס למגע ישיר עם הוריהם? הרי מדינת ישראל עצמה מגדירה ילד כמי שטרם מלאו לו 18 שנים, אז למה הוא מפסיק להיות ילד אחרי גיל 8 אם הוא בן של אסיר פוליטי? למה ארגוני זכויות אדם שותקים על העובדה שאסיר ביטחוני אינו יכול לחבק את בני משפחתו או לגעת בהם או להתייחד עם אשתו במשך כל תקופת המאסר, שיכולה להיות שנים ואפילו מאסר עולם מתמשך? למה שותקים המוסדות האחראיים על ביקורת החוק, כאשר מדובר בהפרות חמורות בזכויות אסירים ביטחוניים – יותר מכל קבוצות אסירים אחרת?
ייתכן שהדרך לשינוי המצב והפסקת הפרות זכויות האדם אינה במשפט הישראלי ולא בזירה הישראלית, אלא דרך מערכת המשפט וההגנה הבין-לאומית. מהלך כזה מחייב התגייסות אינטנסיבית יותר של ארגוני זכויות אדם ובעלי המצפון, אינטלקטואלים ביקורתיים, פעילים חברתיים ופוליטיים. אותם ארגונים ואיגודים מקצועיים שמוחים כיום על המצב הקיים בישראל, צריכים למחות גם הם על ההפרות הבוטות בתנאי המחייה של האסירים, על התנאים הבלתי אנושיים שהפכו את בתי הכלא למכלאות, ואת התאים לכלובים.

المعتقلات والسجون الإسرائيلية بعيدة كل البعد عن المستوى المقبول في الدول المتقدمة. هناك انتهاكات خطيرة لحقوق الإنسان فيها، ظروف سجن قاسية، مبان لا تستوفي المعايير التي حددتها المحكمة الإسرائيلية بنفسها، اكتظاظ كبير واختناق في الزنازين. هناك انخفاض مستمر في الحيز المتاح لكل سجين، وهو أصلا اقل بكثير من المطلوب؛ ظروف صحية سيئة تشكل أحيانا خطرا حقيقيا، تهوية غير ملائمة، تقصير في توفير العلاج الطبي للسجناء والمعتقلين ؛ مشاكل في تطبيق الحق بلقاء أبناء العائلة وفي الحق في لقاء محام؛ نقل المعتقلين الى جلسات المحاكم لا يستوفي الشروط المطلوبة، قصور واضح في منالية وصول السجناء إلى جلسات مداولات التماسات قدموها أمام المحكمة المركزية والى جلسات الإفراج المبكر التي تجري أمام لجان إطلاق السراح. الأسرى السياسيون (من تسميهم إسرائيل وكذلك التقرير "أمنيين"). إضافة للانتهاكات المذكورة أعلاه، ممنوعون من العلاج الاجتماعي، ومن أي فعالية ترفيهية.  هذا بعض مما جاء في التقرير الأخير(آب 2011) الذي قدمته وزارة العدل ومكتب الدفاع العام عن الوضع  في السجون للعامين 2009 و 2010 وحتى بداية 2011. يشار إلى أنه بعد إنهاء العمل على التقرير، وبقرار حكومي وفي أعقاب تصريحات نتانياهو في حزيران عن قراره "باتخاذ جملة من الإجراءات لتغيير الظروف السائدة في السجون" ضد الأسرى السياسيين، تم مؤخرا وقف التعليم، ومنع إيصال الكتب لهم من خلال زيارات العائلات، إضافة لجملة من الانتهاكات الجديدة وتشمل عمليات "جرد" للغرف ولكل حاجياتهم واحتجازهم لساعات طويلة لغاية إنهاء التفتيش، وعادة ما يتم ذلك في ساعات نومهم إضافة لعدد من الانتهاكات الإضافية ضدهم وضد أسرهم. 
يلخص التقرير المذكور النتائج الرئيسية كما وردت في التقارير الفردية التي قدمها ممثلو مكتب الدفاع العام بشأن ظروف الاعتقال والسجن وحماية حقوق المعتقلين والسجناء، والتي سُجلت في أعقاب زيارات رسمية قاموا بها الى السجون والمعتقلات في الفترة المذكورة، يقع  26 منها تحت مسؤولية مصلحة السجون و 10  تحت مسؤولية الشرطة، و 13 موجودة في مباني المحاكم وتقع تحت مسؤوليتها والتي يتم إحضار المعتقلين اليها من أجل عقد جلسات استماع في قضاياهم.  تم، خلال الزيارات، فحص مدى ملائمة مرافق الاعتقال للظروف المنصوص عليها على أنها تشكل الحد الأدنى من شروط الاعتقال والسجن وفق عدة قوانين ذات صلة، وذلك من منطلق  "أن المعايير المحددة بالقانون بخصوص احتجاز المعتقلين ينبغي أن تشكل الحد الأدنى من مستوى الشروط التي يجب أن يحتجز بها السجناء الذين حوكموا". 
لقد تم تقديم التقرير وكما في كل سنة، الى جهات مسؤولة عن تطبيق القانون فيما يتعلق بالسجناء وعن مراقبة صحة تطبيقه ومنها: المستشار القضائي، وزير الأمن العام ، وزير العدل، مدير عام الشرطة ، ممثل مصلحة السجون، رؤساء المحاكم التي تم فحصها.  

فيما يلي بعض النتائج الأساسية التي يعرضها التقرير:
أ‌)       السجون والمعتقلات التابعة لخدمة مصلحة السجون -  يقول التقرير "وجدنا عددا من الانتهاكات الخطيرة لحقوق السجناء . الصورة التي تبرز في عدد من السجون قاتمة. شكاوى حول عقوبات مبالغ فيها في مجالات مهمة؛ التقييد والربط غير متوازن ؛ اكتظاظ شديد ، ظروف صحية سيئة ، وأحيانا إلى درجة تشكيل خطر حقيقي على صحة السجناء وظروف التهوية غير لائقة ، لا فصل بين دش الحمام ومقعد المجاري بحيث يضطر السجناء الى الاستحمام فوق المكان الذي قضى فيه السجناء الآخرين حاجاتهم ؛ نقص في المعدات الأساسية للسجناء؛ قصور في توفير العلاج الطبي ؛ قصور في عملية تقديم التماسات السجناء وفي معاملات لجان إطلاق السراح .." ؛ "في الكثير من المعتقلات.. لا يتماشى الاكتظاظ الشديد في الزنازين مع احترام الكرامة الإنسانية للسجين أو المعتقل " ؛ "نقص في عدد العمال الاجتماعيين نسبة لعدد السجناء، رفض إعطاء علاج اجتماعي للسجناء الأمنيين ؛ قصور في كل ما يتعلق بأطر العمل والتعليم". يؤكد التقرير "أن القصور في هذه المجالات لا يتناسب البتة مع أهداف السَجِن، فالهدف ليس فقط أبعاد عن المجتمع ، بل أيضا فرصة لإعادة التأهيل ومنع العودة إلى المخالفات في المستقبل ودمج طبيعي في المجتمع".  في هذه الوضعية من الانتهاكات، يصبح السجن المكان الذي يخدم الهدف الذي، حذر منه ممثلو مكتب الدفاع ، أي الاستبعاد من المجتمع ، والردع ، خاصة عندما لا يتيح السجن أي اتصال مع العالم الموجود خارج جدرانه ، كما في حالة الأسرى السياسيين.

ب‌)  السجون والمعتقلات الواقعة تحت مسؤولية الشرطة – وجدت فيها نتائج مماثلة لسابقتها، بل وأكثر صعوبة. حيث يبين التقرير أنه لا تزال هناك انتهاكات لتعليمات قانون الاعتقالات والأنظمة المسنونة على أساسه ويتضح ان الغرف ضيقة ومزدحمة؛ أوجه قصور خطيرة في الحمام والاستحمام بحيث يجبرون المحتجزين على الاستحمام من فوق مصرف المجاري ؛ انتهاك للحق في المشي يوميا في الهواء الطلق ، مشاكل في تطبيق الحق في لقاء أفراد الأسرة. انتهاك حق المحتجزين في لقاء محام في  ظروف مناسبة ودون إبطاء وفي الحق في الحصول الحر وأمور قانونية؛ ونحن نشير الى انه في بعض الحالات المعروفة لمنظمات قانونية، كان هناك شك بتنصت غير قانوني من قبل السجن الى أحاديث المحامين مع المعتقل.  يقول كاتبو التقرير انه بالرغم من  أنه في بعض هذه المعتقلات كان القصور نابعاً من القيود الموضوعية بشأن حجم المعتقل والفترة التي بني فيها، الا انه  "لا يمكننا أن نقبل مع  معظم الانتهاكات/التقصير ولا أن نوافق عليها..هناك حاجة لاستثمار الموارد من أجل القيام بإصلاح الوضع في أقرب وقت ممكن".   

ج) مرافق الاحتجاز التابعة للمحاكم في جميع أنحاء البلاد - الوضع هناك ليس أفضل حالا . حيث "تتضح صورة قاسية لظروف احتجاز المعتقلين في هذه المنشآت".   في عدة معتقلات وجدت "درجة اكتظاظ لا تطاق، غرف لا تتسع الى لعدد قليل من سجناء لساعات محدودة؛ الغالبية العظمى منها بظروف صحية وتهوية دون المستوى المطلوب، أوساخ وروائح كريهة، هناك الكثير من النواقص في وضع الحمامات؛ في العديد من المعتقلات لا توجد شروط محترمة ملائمة للقاء محام -زبون الأمر الذي يؤدي إلى إساءة للحق في التشاور ؛ قصور في ترتيبات مرافقة المعتقلين الى المحاكم، مما يتسبب في أضرار جسيمة لحقوق السجناء، إرهاقهم في السفر لعدة ساعات، الخروج من السجون في وقت مبكر جدا إضافة لسفر مسافة طويلة، قصور في توزيع المواد الغذائية والماء لهم خلالها يؤدي إلى ان المعتقلين يصلون مرهقين، جائعين ومحبطين إلى المحكمة، والتي قد تكون مصيرية بالنسبة لهم. قصور في توزيع المعتقلين بعد انتهاء المداولة. زيادة مدة إقامتهم في مرافق الاحتجاز التابعة للمحاكم أكثر من الوقت المطلوب لاستكمال الإجراءات اللازمة لشؤونهم القانونية ، نقل المعتقلين مكبلي الأيدي أو الأرجل في أروقة المحاكم والقاعات، بغالبية الحالات أمام أعين الجمهور العام.. مما يمس بشدة بكرامتهم ويؤدي إلى إذلالهم ". وذلك على الرغم من أن القانون يؤكد على عدم تقييد المعتقلين بالأغلال في مكان عام ، إلا في حالة الاستثناءات التي حددها القانون. من المعروف ان المعتقلين السياسيين يتم إحضارهم مكبلين بالأغلال من الأيدي والقدمين، ويتم إبقاؤهم بالأغلال أثناء المناقشة بأكملها أمام أعين الجمهور ، بما في ذلك أولاد قاصرين يحضرون المحكمة كأولاد السجين الموقوف نفسه. او أقارب درجة ثانية لا يقدرون ان يروه الا في قاعة المحكمة حيث الزيارة في السجن ممنوعة. لا يمكن الافتراض هنا ان الأمر ينبع من أسباب أمنية حقة، فالمعتقل يكون خلال كل النقاش محاطا بعدد من حرس مصلحة السجون، وعدد من أفراد أمن المحكمة، إضافة إلى حاجز مرتفع يفصله عن الجمهور والقضاة،  لذا من الصعب جدا أن نصدق ان التقييد نابع من الخوف على سلامة الجمهور المتواجد بالقاعة. 

يشير التقرير أنه "بالرغم من محاولات تحسين الوضع وخصوصا في نقل المسؤولية عن المعتقلات الإقليمية ومسؤولية مرافقة المعتقلين من حراسة الشرطة إلى مصلحة السجون فان الوضع ..ما زال بعيدا عن أن يكون مُرضِيّا.. فالحديث ليس عن مشاكل عينية أو فشل عيني، بل عن مشكلة عامة على نطاق واسع على مستوى الدولة ، التي تؤدي للأذى اليومي والضرر في الحقوق الأساسية للمعتقلين والأسرى ، والأضرار بكرامتهم كبشر " ويأمل معدو التقرير أن يساعد ملخص نتائج الزيارات، المسؤولين في إيجاد حل مناسب لأوجه القصور القائمة خاصة تلك الخطيرة بينها التي تتطلب استجابة وحلول فورية."   و "أن تكون لديهم الحكمة كي يستفيدوا من المعلومات من أجل تحسين النواقص الشاملة والخطيرة بأسرع ما يمكن". 
يؤكد ممثلو مكتب الدفاع العام، أنهم يرون في "المحافظة الصارمة على حقوق وكرامة الأشخاص الذين قام المجتمع ، بموجب القانون ، بسلب حريتهم، أحد الاختبارات الرئيسية للحفاظ على حقوق الإنسان في إسرائيل" . وذلك من منطلق أن السجن يلزم ، بحكم تعريفه ، سلب الحرية ، ولكنه لا يبرر ، بحكم طبيعته ، انتهاك كرامة الإنسان. حيث يمكن تطبيق السجن الذي يحافظ على الكرامة الإنسانية للسجين. من منطلق أن جدران السجن لا يجب ان تفصل بين السجين وإنسانيته... والسجن لا يجوز له أن يتحول الى مقفص، والزنزانة ممنوع ان تتحول الى قفص". 
ان الصورة التي يعرضها هذا التقرير، تؤكد أن إسرائيل فشلت في اجتياز اختبار احترام حقوق الإنسان في كل ما يتعلق بالسجناء. وتبين أن السجون الإسرائيلية عبارة عن أقفاص تعزل الإنسان عن إنسانيته ومجتمعه. ان الانتهاكات الخطيرة التي تتحدث عنها هذه التقارير سنة بعد سنة، تؤكد الأمر نفسه الذي تحذر منه منظمات حقوق الإنسان وكذلك السجناء أنفسهم وأسرهم .  
فعندما تقوم أجهزة تطبيق القانون كمصلحة السجون والشرطة ذاتها بشكل منهجي وبنيوي ومستمر في انتهاك حقوق الإنسان كما يبين التقرير، يثار تساؤل مفاده الى أي درجة يكون ممثلوها حقا معنيين بحل جذري لهذه الانتهاكات؟ وهل ينتظر المسؤولون عن السجون تقارير الدفاع العام ووزارة العدل لتخبرهم بالوضع القائم في سجونهم؟ أليسوا هم المسؤولين عنه؟. وان كان الأمر كذلك، وهو كذلك، فما الفائدة من تقديم التقارير لهم؟. وإبقاء الأمر بمفهوم معين أمرا داخليا وحله ومعالجته رهن رغبة مصلحة السجون ووزير الأمن الداخلي والشرطة..
نحن نقول ان مشكلة الأسرى وظروفهم المعيشية داخل السجون وظروف اعتقالهم وسجنهم يجب أن لا تكون مشكلة السجناء الفردية وأسرهم ولا مشكلة داخلية تعالجها مصلحة السجون وغيرها من أقسام هي نفسها سبب المشكلة. وهي ليست شأنا إسرائيليا داخليا، فهذا ما تريده إسرائيل. ان هذه أمور يجب ان تُقلق كل شخص يرفع شعار حقوق الإنسان ويتمسك بالقيم والنهج الإنساني والنقدي حول جهاز القانون و حول القوة المطلقة التي تمتلكها الدولة وأجهزتها ضد مواطنيها، وخصوصا ضد المجموعات الأكثر إضعافا وقمعا من بينها بحكم وضعهم القانوني ، كالسجناء والأسرى. 
ونحن نقول ان قلقنا هنا هو بشكل خاص  على الأسرى السياسيين ولظروف حياتهم داخل السجون، والتي هي دون المستوى الإنساني المطلوب. فإضافة لجملة الانتهاكات الخطيرة التي تحدث عنها التقرير، فان الأسرى السياسيين موجودون في عزله تامة عن أي اتصال مع العالم الخارجي ، باستثناء أقارب من الدرجة الأولى والذي يجري هو أيضا في ظروف قاسية جدا ، لقاء من خلف الزجاج، منع اللمس ، حتى مع القاصرين وكبار السن. فالأسير محروم من حقه أن يشعر بإنسانيته .  فدائرته الاجتماعية يتم تقليصها لزملائه في الزنزانة ، والقسم بحد أقصى ، وأفراد العائلة المباشرين.  عالمه مقلص إلى الحد الأدنى ، حيث يُمنع من القيام بأي نشاط اجتماعي أو تعليمي. مساحة المعيشة الإنسانية مقلصة، وتقتصر على الزنزانة، والساحة الداخليّة للسجن بساعات قليلة ومحدودة خلال النهار، إضافة لغرفة الزوار التي يحضرها مرة كل أسبوعين للقاء العائلة لمدة لا تزيد عن 45 دقيقة. بينما تمنع منه أيضا أي خدمة اجتماعية . إضافة إلى أن مصلحة السجون تعمد العقاب الجماعي ضدهم، ومنه التفتيش الجسدي لهم ولأسرهم، منع التعليم ومنع الكتب وغيره. الأمر الذي لا تتعامل معه مصلحة السجون على انه انتهاك لحقوق الإنسان متذرعة بالقانون وتعليمات مصلحة السجون التي تخصص بنودا خاصة لكيفية التعامل مع الأسرى لسياسيين، خلافا للجنائيين. 
وبينما تشهد البلاد مؤخرا حالة من الحراك والاحتجاج الاجتماعي ضد السياسات الاقتصادية للنظام القائم وتأخذ المنظمات والنقابات المهنية دورا في هذا الاحتجاج. أتساءل هنا إضافة لكوني زوجة أسير، كعاملة اجتماعية ناشطة في مجال حقوق الإنسان ، اين نقابة العمال الاجتماعيين ، وهي منظمة واسعة وكبيرة من الوضع الراهن في السجون، لماذا تصمت على حقيقة ان الخدمات الاجتماعية في السجون منقوصة وانتقائية وتمنع من أسرى دون غيرهم ؛ لماذا تصمت نقابة الأطباء على ظروف المعتقلات وحقيقة أن العلاجات الطبية التي تقدم للسجناء وللمعتقلين تفتقر إلى الكثير من الأسس المهنية وفيها انتهاك واضح لحقوق المريض؛ وماذا تفعل نقابة المحامين مع حقيقة أن شروط ظروف اللقاء بين المحامي والأسير، خاصة السياسي ، مخترقة داخل السجون تحت تغطية قانونية؛ لماذا تصمت منظمات حقوق الطفل الإسرائيلية، على التمييز ضد الأطفال -أبناء المعتقلين السياسيين – حيث يمنع من هم فوق سن الثامنة ، بموجب تعليمات مصلحة السجون من اللقاء المباشر مع أهاليهم السجناء ! مع العلم ان الدولة نفسها تعرف الطفل بأنه شخص دون سن 18 عاما!
يعاني الأسرى السياسيون الفلسطينيون في السجون الإسرائيلية من انتهاكات تمس حقوق الإنسان، ويعيشون ظروفا تقلل من كرامتهم الإنسانية، وحتى تقارير رسمية كالتقرير المذكور، تؤكد بذلك. ولا تقوم دولة إسرائيل بالعمل على تغيير الوضع، وتتعامل معه على انه شأن داخلي يخصها. بينما تصمت النقابات المهنية عن هذا الوضع ولا تثور ضده. من هنا واجبنا فان الأخلاقي والإنساني ، التصدي لهذه السياسات وفضحها وتجنيد الدعم الدولي ضدها.   وربما كان الطريق الى حماية الأسرى السياسيين هو من خلال المحكمة الدولية ، الأمر الذي يتطلب تعبئة مكثفة وحملات منظمة من منظمات حقوق الإنسان وأصحاب الضمائر والمثقفين النقديين والنشطاء الاجتماعيين والسياسيين.
